We resolved on this today at the CSSWG - accepting the majority position. Layer order will be dynamic, based on currently matching conditions. github.com/w3c/csswg-drafts/issues/6407#issuecomment-871547852 We still need to define special behavior inside container queries - which do not have a global "matched" state.
